Terms of use

Draft: this text hasn't been reviewed by a lawyer yet and will change before Amarelle opens to the public.

Amarelle is a marketplace where people in the San Francisco Bay Area buy and sell inspected items. Sellers inspect items on camera before listing them. Buyers pay when the meetup is set, Amarelle holds the money, and the seller is paid 72 hours after the handoff. These terms explain the rules for both sides.

These terms

These terms are an agreement between you and [company name] ("Amarelle", "we"). By using Amarelle, you agree to them and to our privacy policy.

Who can use Amarelle

  • You must be 18 or older.
  • You need a US or Canadian mobile number, and deals take place in the San Francisco Bay Area.
  • One account per person. Keep your number current; you're responsible for what happens in your account.

What Amarelle does

Amarelle doesn't own or sell the items listed. Each sale is between the buyer and the seller. Amarelle runs the inspection, holds the buyer's payment, books the meetup, settles disputes and keeps records.

An inspection report describes what the seller's video showed, graded by our AI and checked by people when it's unsure. It is not a warranty. Some checks can only be confirmed in person, and the report says which.

[Disclaimers and limits of liability will be added after legal review.]

Selling

  • You can sell bikes (non-electric), phones and tablets, laptops or game consoles, priced from $150 to $3,000.
  • Only sell items you own and have the right to sell. No stolen, counterfeit or recalled items.
  • Inspect the item you're selling, live, with the camera in our page: no old videos, no other item, no hiding defects.
  • You set the price and the lowest offer you'd accept. Your agent never reveals that limit.
  • Selling is free. You're paid 72 hours after the handoff, once the buyer's claim window closes.
  • Payouts are made through Stripe. To be paid, you set up a payout account with Stripe and accept Stripe's agreement for connected accounts during that setup. You authorize Amarelle to share your information and your sales with Stripe for this.

Buying

  • Prices shown include Amarelle's service fee, paid by the buyer: $25 for items up to $399.99, $45 for items up to $1,000, and $75 above $1,000.
  • Your first purchase can be up to $1,000.
  • You can make one offer on an item, and the seller can make one counter-offer.
  • Once you and the seller agree on the price and the meetup, you have 2 hours to pay, or the deal lapses. Amarelle holds your payment until the deal ends.

Meetups

  • Meetups happen at public spots from our list, starting between 8am and 8pm Pacific time, at least 3 hours and at most 14 days ahead.
  • Check in from your phone when you arrive, from 30 minutes before the meetup. Check-in uses your location to confirm you're within 150 meters of the spot.
  • Each side can reschedule once, and cancel or reschedule until 24 hours before the meetup.
  • Someone who hasn't checked in 15 minutes after the start time is a no-show.

At the handoff

  • The buyer checks the item against its report. If it matches, the buyer gives the seller their release code, and the seller enters it to complete the sale.
  • If the buyer simply changes their mind, they can decline the item: they get the item's price back; the service fee isn't refunded, and no record is kept.
  • If the item doesn't match its report, the buyer reports a mismatch on the spot, with photos of the problem. Amarelle reviews it; if it's confirmed, the buyer gets a full refund and the seller gets a record.

After the handoff

If you find a problem the report missed and that couldn't be seen at the meetup, report it within 72 hours. The seller is paid only once that window closes. If Amarelle confirms the claim, you get a full refund.

No-shows

  • If the seller doesn't show up, the buyer gets a full refund. If the buyer had checked in, the seller gets a record.
  • If the buyer doesn't show up, the buyer gets the item's price back, but not the service fee; the seller receives $10 of it for their time. If the seller had checked in, the buyer gets a record.
  • If neither shows up, the buyer gets a full refund and nobody gets a record.

Records and appeals

Confirmed no-shows and items that didn't match their reports become records. A summary appears on your profile, so others can see how you've traded. You can appeal a record by writing to us; a person reviews every appeal.

[How long records stay on a profile will be set with our lawyer.]

Your agent

  • Your agent works only for you, within the limits you set.
  • Anything that commits you (accepting an offer, a price or a meetup) waits for your yes.
  • Your agent never tells the other side your limits.
  • AI can make mistakes. Read what your agent proposes before you approve it.

Text messages

  • Amarelle alerts: when you give us your mobile number, you agree to receive texts from Amarelle: sign-in codes, updates about your listings and deals, and meetup reminders.
  • Message frequency varies with your activity, usually a few messages per deal.
  • Message and data rates may apply.
  • Reply STOP to stop receiving texts, or HELP for help. For help, you can also write to [support email].
  • Sign-in codes are texts too: after STOP, you can't sign in until you reply START.
  • Carriers aren't liable for delayed or undelivered messages.

Not allowed

  • Faking an inspection, or listing an item you don't have.
  • Taking a deal off Amarelle, or asking for contact details to do so.
  • Harassing anyone, or meeting anywhere other than the booked spot.
  • Creating more than one account, or using bots to access the site.

Amarelle can remove listings and suspend accounts that break these terms. Open deals are settled first.

Changes, disputes and contact

We'll post any change here, and text you before a change that affects your open deals.
